Terms and conditions of sale

All orders imply the buyer’s unreserved acceptance of SARL VINS SIPP MACK’s general terms and conditions of sale. None of the clauses on orders or correspondence received from purchasers can therefore derogate from them unless otherwise stipulated in our offers or acceptances.
The parties agree that these general conditions are subject to French law.

The wines offered on this online store are reserved exclusively for Metropolitan France.

All vintages indicated in our price lists and proposals are available while stocks last. The prices of the products marketed by SARL VINS SIPP MACK are indicated in euros, all inclusive of tax, except expenses of delivery. Only the price in force at the day of the order will be applied. The total price indicated on the form of order takes account of the whole of the ordered products, all inclusive of tax and includes the carriage costs. This total corresponds to the final price to be paid by the customer.

If, on receipt of an order, the requested vintage is no longer available, we reserve the right to deliver the next closest vintage. For each wine ordered, the buyer will be informed of the impossibility of delivery and will be able to modify or cancel his order.

The offer is deemed to have been accepted as soon as the order form has been validated by the purchaser. Contractual information will be confirmed by e-mail at the latest at the time of dispatch. Confirmation of the order will include all contractual details: products ordered, price, method of payment, delivery date.

Payment is made by credit card (Eurocard/ Mastercard/ Visa), in euros, on registration of the order, on the site guaranteed by the use of the SSL security protocol. This system ensures total confidentiality of personal information transmitted on the site. Your bank details are also protected, as they are never communicated to us, but are transmitted directly to the bank by CIC MONETICO in a secure manner that cannot be used by third parties.

Payment by cheque is also accepted. In this case, please send us your payment, together with the order form, payable to VINS SIPP MACK. As soon as we receive your cheque, we will dispatch your order.

We ship in 6-bottle cases. Products can be mixed and matched. Delivery usually takes place within 15 days, subject to payment of the invoice by the buyer.

After packing in shipping cartons, the wines ordered are handed over to our regular carriers, chosen for their reliability. Packages are delivered to the address indicated by the buyer on the order form. For better tracking of deliveries, we ask you to inform us of any delay in delivery.

Free delivery for single-address orders over €400. For orders under €400, please add €35 for postage.

All our shipments are sent in perfect condition in sturdy cartons. Carriers are fully responsible for any damage incurred en route. Even when shipped carriage paid, goods travel at the consignee’s risk. On delivery, we ask you to note any broken bottles or missing parcels and to sign the transport note “subject to damage noted on unpacking” and inform us immediately. We will refund or reship the bottles concerned.

In the event of nonconformity of the delivered good, the purchaser will have to formulate a complaint near VINS SIPP MACK. In accordance with articles L.120-20 and following of the Code of consumption, you have the faculty to retract during a 7 working days deadline as from the day of the reception of the wines. During this period, you may return the bottles in their original packaging at your own expense. Bottles must be intact and unopened.

VINS SIPP MACK undertakes to reimburse you, without penalty, all sums paid within a maximum of 30 days from receipt of the return of the wines. The only costs that can be charged to the customer are the direct costs of returning the bottles.

The personal information collected by VINS SIPP MACK in the form of order is necessary to the treatment of the order placed by the purchaser. If all the fields marked with an asterisk are not informed, the order could not be taken into account by Wines SIPP MACK.

The information collected is used exclusively by VINS SIPP MACK. In accordance with the Data Protection Act of January 6, 1978, the buyer has a right to access, modify, rectify and delete data concerning him with : VINS SIPP MACK, 1 rue des Vosges, F- 68150 Hunawihr.

Any case of force majeure (transport strike, postal strike, severe weather, etc.) suspends the obligations arising from the present contract. Neither party will be held responsible for the total or partial non-performance or delay in performance of its obligations.

Any dispute relating to the validity, interpretation or performance of this contract will be subject to the jurisdiction of the courts of Colmar 68 (Haut Rhin).
